I was pulled over today for a “tail light out” I gave the officer the registration, insurance and driver’s license. I was ticketed for no seat belt. The question I have is that my lap belt and shoulder harness are two separate belts. The shoulder harness is automatic, when you get in it straps you in when you shut the door, the lap belt however is manual. I was given a ticket because the lap part of the belt was not fastened. After leaving the sean I went to wal-mart to get a bulb along with some other things. The Officer never told me which light was out so when I got to wal-mart I asked a fellow shopper to look and tell me which one I needed to change. I was told they were all working, I also checked turn signals etc, and could find no problems. My question is do both belts need to be buckled or is shoulder harness sufficient to cover the seat belt laws?

By law, front passengers are required to wear both seat belts, rear passengers are required just the lap belt. As for the ticket, I would fight it because the stop was not legal, since there was no light that was out. Reasonable suspicion is needed to stop someone, this comes in when they “think” you are drunk, swerving, etc. Probable cause is founded proof. You were speeding, ran a stop sign, light out, etc. Since there was no other reason than the light was out, and the light wasn’t out, then he made an illegal stop. anything found after that is covered under the Fruit of the Poisonous Tree Doctrine.
